1. General Terms and Conditions

1.1 The e-shop of the Estonian Art Museum sells publications, reproductions and souvenirs related to collections and exhibitions.

1.2 When purchasing from the e-shop of the Estonian Art Museum, the terms and conditions of this agreement, the price list of the products of the e-shop and the rights and obligations arising from the legislation of the Republic of Estonia apply.

The order conditions and the price list of valid e-store products are available on the website of the Estonian Art Museum e-store.


2. Product ordering procedure

2.1 The customer selects the products that suit him, determines the quantity of the products, the method of payment for the products and the method of delivery. Before submitting the final order, the customer can review and change the order. The customer then confirms the order by clicking the “Back to Merchant” button after payment. Otherwise, the order will not be activated. After confirming the payment, a message confirming the order will be sent to the subscriber’s e-mail address. Orders can be submitted in Estonian or English.


3. Product Delivery

3.1 The ordered products will be delivered to the customer by the Estonian Art Museum’s e-shop according to the delivery method chosen by the customer: via the Omniva parcel machine, ELS courier, Kumu or Niguliste museum shop.

3.2 The customer chooses the method of delivery of the products by filling in the order form. The fixed delivery price list is visible to the customer in the order form.

3.3 Delivery methods:

3.3.1 Omniva parcel machine

– The ordered products will reach the customer via the Omniva parcel machine within 3-5 working days from the receipt of the order confirmation to the customer’s e-mail address (except for reproductions).

– The ordered reproductions will reach the Omniva parcel machine within 7 calendar days (except for special orders, in which case the time of completion and a suitable method of delivery will be agreed separately with the customer).

– Delivery fee 4.50 euros.

– The customer selects the parcel machine with the location closest to him from the list given in the order form.

– When the order arrives at the parcel machine, a message will be sent to the customer’s mobile phone and e-mail address stating the location of the parcel machine, opening hours and personal door code. When entering the door code, the door of the parcel machine opens and the customer receives the ordered parcel. The order will be kept in the parcel machine for 7 calendar days from the time the message is sent to the subscriber’s mobile phone and e-mail address. If the customer has not removed the parcel from the vending machine within 7 calendar days, Omniva will return the parcel to the Estonian Art Museum. In this case, the Estonian Art Museum will contact the customer to specify the receipt of the package. If the subscriber is not contacted or no agreement is reached, the order will be canceled. The amount paid for the order will be returned to the customer’s current account, except for reproductions and their special orders. Ordered reproductions and their special orders are not subject to cancellation.

3.3.2 Omniva courier

The ordered products will be delivered by courier to the address indicated by the customer within 48 hours from the sending of the order confirmation to the customer’s e-mail address (except for reproductions).

– If the order is placed on a weekend (Friday from 12.00 to Sunday at 24.00) or on a public holiday, the 48-hour period will run at 9.00 on the first working day following the weekend or public holiday.

– In the case of reproductions, the delivery time is up to 7 calendar days (except for special orders, in which case the time of completion and the appropriate method of delivery are agreed upon separately with the customer).

In the case of courier delivery, the courier agrees with the customer at a suitable time for delivering the parcel. Delivery to a business customer will be without a prior call and to the address shown on the parcel. If it is not possible to deliver the parcel at the agreed time, the subscriber will be contacted by telephone. If the courier cannot contact the customer by telephone, a notice will be left in the customer’s mailbox and the parcel will be delivered to the nearest post office. During the 14-day return period, the bar code on the product package must be retained, allowing the package to be returned to the nearest post office within the specified time. If the customer has not picked up the parcel from the post office within the 14-day return period, Omniva will return the parcel to the Estonian Art Museum. In this case, the Estonian Art Museum will contact the customer to specify the receipt of the package. If the subscriber is not contacted or no agreement is reached, the order will be canceled. The amount paid for the order will be returned to the customer’s current account, except for reproductions and their special orders. Ordered reproductions and their special orders are not subject to cancellation.

3.3.3 Kumu or Niguliste Museum Shop

– Receipt of the package from the Kumu or Niguliste Museum Shop is free of charge. The ordered products, except for reproductions, will reach the museum shop at the location chosen by the customer on the next working day if the order is placed before 14.00 on the working day. Orders placed after 2 p.m. The ordered reproductions will reach the desired museum store within 5 working days (except for special orders, in which case the time of completion and the appropriate method of delivery will be agreed separately with the customer). A notification about the arrival of the order in the store will be sent to the e-mail address. The customer will receive the order from the museum shop within 14 calendar days on the basis of an identity document. If the customer has not followed the order within 14 calendar days, the Estonian Art Museum will contact the customer to specify receipt of the package. If the subscriber is not contacted or no agreement is reached, the order will be canceled (except for reproductions). The amount paid for the order will be returned to the customer’s current account, except for reproductions and their special orders. Ordered reproductions and their special orders are not subject to cancellation.

3.4 Delivery of the product outside the Republic of Estonia

Through the e-shop of the Estonian Art Museum, it is possible to order products outside the Republic of Estonia. To order abroad, select the appropriate destination from the list of countries. If the desired country is not in the list of countries to be sent, please contact us at pood@ekm.ee . Depending on the country, it takes 7-30 business days for the shipment to arrive (except for reproductions). The ordered reproductions will reach the desired destination within 10–38 working days (except for special orders, in which case the time of completion and the appropriate method of delivery will be agreed upon separately with the customer).

3.5 The product must reach the customer intact and in a sealed package. Report the product damaged during transport immediately at the e-mail address pood@ekm.ee .

3.6 When you buy a ticket for an art studio course from the e-shop, you will register for the course automatically. Before the course, the museum will contact you to provide more detailed guidelines for participation. Tickets in PDF format will be sent to the e-mail address entered in the data field immediately after the order has been paid for in the Internet bank. The ticket is valid for one person on all dates of the course and allows you to visit the exhibitions of the Kumu Art Museum on those days. The sale of Kumu Art Studio courses in the e-shop ends 2 days before the start of the course (if the course has not been sold out before). If you wish to register later, please contact the curator of the studios by phone +372 5199 7615 or e-mail kumustuudiod@ekm.ee . The course takes place when the group is completed. It is possible to exchange a missed course ticket for a course ticket in the same currency during the year in agreement with Kumu or to get back the amount paid for the course. If you choose a cheaper replacement rate, the price difference will not be refunded. In the case of a more expensive course, the client must pay the price difference.


4. Withdrawal from the order

4.1 The Customer has the right to withdraw from the order within 14 calendar days from the date of receipt of the product (except for reproductions and the Kumu annual ticket, see clause 4.7).

4.2 In order to withdraw from the order, the customer must submit it in writing to the e-mail address pood@ekm.ee . withdrawal application. The withdrawal application must state the order number, the first and last name of the subscriber, the subscriber’s bank account number and the name of the bank account holder.

4.3 If the customer withdraws from the order, the customer undertakes to return the unused and undamaged products immediately, but not later than within 14 calendar days from the sending of the withdrawal application. The customer can return the products to the Estonian Art Museum’s Kumu or Niguliste museum shop or by post to the address: Estonian Art Museum, Weizenbergi 34 / Valge 1, 10127 Tallinn.

4.3.3 Parcels received via the Omniva parcel machine can be returned in the original packaging via the same parcel machine within 14 calendar days, using the return code contained in the message or e-mail notifying the arrival of the parcel.

4.3.4 Parcels received by Omniva courier can be returned in the original packaging within 14 calendar days through the post office of Eesti Post, where the return is based on the barcode on the Product’s packaging.

4.4 The Estonian Museum of Art will return the amount paid for the returned products and the delivery fee to the extent of the amount paid by the customer, but not more than 3.69 + km… If the customer returns the products in part, the delivery fee will not be refunded. The Estonian Art Museum will return the money within 3–14 calendar days after the returned product has reached the Estonian Art Museum. If the reason for the return is a defective product, the Estonian Art Museum will return the shipping costs to the customer in full.

4.5 If the ordered product has been used or damaged, the Estonian Art Museum has the right to demand compensation for the damage up to the selling price of the product, depending on the decrease in the value of the product. The corresponding amount is deducted from the amount returned to the customer.

4.6 If the order has been damaged during shipping, please contact the Estonian Art Museum at the e-mail address pood@ekm.ee .

4.7 Reproductions ordered by the customer and Kumu annual tickets are not subject to a 14-day right of withdrawal, as the ordered products are made taking into account the customer’s personal wishes. In case of complaints or questions, please write to the e-mail address pood@ekm.ee .

4.8 Registration for the studio course can be canceled 5 working days before the start of the course, the purchased ticket can be exchanged for another course ticket in the same currency during the year in agreement with Kumu or the amount paid for the course can be refunded. To do so, please contact: kumustuudiod@ekm.ee . Subsequent claims will not be considered. If it is not possible to participate in all the courses, Kumu Art Museum will not reimburse the participant for the cost of an individual event.


5. Submission of a claim

5.1 The customer has the right to submit claims regarding the product within the time period provided by the legislation of the Republic of Estonia to the e-mail address pood@ekm.ee of the Estonian Art Museum.


6. Obligations of the Contracting Authority

6.1 The Customer is obliged to enter the correct and necessary data in the order in order to successfully complete the order: first and last name, address of residence, contact telephone and e-mail address.

6.2 If the information provided by the customer is inaccurate or incomplete, the Estonian Art Museum will not be able to fulfill the product order. If possible, the Estonian Art Museum will contact the customer regarding the order of the product.

6.3 When placing an order, the customer agrees to the terms of use provided in the e-shop of the Estonian Art Museum.


7. Rights and obligations of the Estonian Art Museum

7.1 The Estonian Art Museum has the right to change the terms and conditions of the e-store agreement and to amend or supplement the existing price list. All changes related to the price list and concerning the terms of the contract will be announced on the website of the Estonian Art Museum.

7.2 The Estonian Art Museum reserves the right to cancel the sale of a product if the price list contains an incorrect price due to a technical or other error.

7.3 The Estonian Art Museum undertakes to send the correct products to the Customer. If the customer notifies about a defective copy of the ordered product, the Estonian Art Museum undertakes to replace the product. A product with a manufacturing defect that has occurred will be replaced if the product was defective when the product was handed over to the customer.
